Lithium Americas (LAC) has announced a hearing for its Thacker Pass Record of Decision appeal.

The company’s Thacker Pass Lithium Project is located in Humboldt County, Nevada. It contains mineral reserves of 3.1 million tonnes of LCE at 3,283 ppm Li.

The U.S. District Court, District of Nevada, has scheduled the oral hearing for January 5, 2023.

As it awaits an official ruling, the company is moving ahead with selecting an EPCM contractor, partnership and supply agreement assessments, and its application with the U.S. Department of Energy loan program.

Since 2021, all four injunction requests related to the company’s cultural assessment required in the Record of Decision were denied in Federal Court.

Thacker’s Environmental Impact Statement (2022), with assistance from the Fort McDermitt Paiute and Shoshone Tribe, determined that it contains no archeologically significant areas.

The company remains committed to providing the Tribe with training and other benefits as mining activities move forward.

“With all state and federal permits received to begin construction, the ruling on Thacker Pass’ Record of Decision represents the final regulatory hurdle to move forward with the largest and most advanced lithium chemicals project in the U.S.,” stated Jonathan Evans, Lithium Americas’ President and CEO.
